PushPin Terms of Service

Operator: ALENT Technologies LLC ("ALENT", "we", "us", "our")
Service: PushPin — NFC-enabled travel-pin web and mobile applications, the related cloud-hosted infrastructure, and any associated documentation or content (collectively, the "Service")
1. Acceptance of these Terms
By creating an account, accessing, or otherwise using the Service, you ("you", "the User") agree to be legally bound by these Terms of Service ("Terms") and by our Privacy Policy. If you do not agree, do not use the Service.
You represent that you are at least 18 years of age, have the legal capacity to enter into these Terms, and — if accepting on behalf of an organization — have the authority to bind that organization.
2. The Service
The Service lets you create digital "pins" that associate locations on a map with photos, videos, and notes you upload, generate public URLs for each pin, and (optionally) write those URLs to physical NFC tags. The Service is offered on a software-as-a-service basis and is provided "as is" and "as available".
We may add, change, suspend, or remove features at any time without notice. We are not obligated to provide the Service forever or to retain any data indefinitely.
3. Your account
3.1 Registration
You must provide accurate, current, and complete information when you register and must keep that information up to date. You may use email-and-password, an OAuth provider we support (such as Google or Facebook), or other authentication mechanisms we add over time.
3.2 Security
You are solely responsible for safeguarding your password and any tokens that grant access to your account. You must notify us immediately at the contact address below if you suspect unauthorized access. You are responsible for all activity that occurs through your account, whether or not you authorized it.
3.3 One account per person
You agree to maintain only one account per identity unless we have given you written permission otherwise. We reserve the right to merge or close duplicate accounts.
4. Your content
4.1 Ownership and license
You retain all rights, title, and interest in the photos, videos, text, location data, and other content you upload to the Service ("Your Content"). By uploading Your Content, you grant ALENT a worldwide, royalty-free, non-exclusive, sublicensable license to host, copy, transmit, display, and otherwise process Your Content solely for the purpose of providing and improving the Service, including delivering it to other users and viewers you choose to share it with.
We do not claim ownership of Your Content. We do not use Your Content to train artificial-intelligence models. We do not sell Your Content to third parties.
4.3 Public-by-default sharing
Every pin you create generates a publicly accessible URL. Unless you enable the password-protection feature, anyone who has the URL or who taps a programmed NFC tag can view the pin's title, location, photos, videos, and notes.
You are solely responsible for who you share each URL with and for any consequences of that sharing. You acknowledge that URLs can be forwarded, screenshotted, or otherwise re-shared in ways you cannot control once disclosed; that the Service's password-protection feature is a deterrent, not a guarantee, and is appropriate only for casual privacy protection — not for sensitive information; and that search engines or other automated indexers might fetch and cache public pin pages.
If you require strong confidentiality for any content, do not upload that content to the Service.
5. Acceptable use
You agree not to use the Service to upload unlawful, defamatory, harassing, abusive, fraudulent, obscene, hateful, threatening, or privacy-invasive content; child sexual abuse material; content infringing third-party intellectual property; malware; spam; or to engage in scraping, security probing, reverse engineering, impersonation, or sanctions violations. We may remove content and terminate accounts at our sole discretion.
6. Plans, payments, and billing
Paid plans are billed monthly in advance via Stripe. You authorize ALENT and Stripe to charge your payment method automatically on each renewal date until you cancel. All fees are non-refundable except where required by law. If you cancel mid-cycle, your subscription remains active through the end of the current billing period and is not prorated.
7. Service availability, performance, and data
The Service is provided without any uptime, performance, or response-time commitment. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING YOUR OWN COPIES OF YOUR CONTENT. We strongly recommend downloading local copies of any content you cannot afford to lose, especially before cancellation, downgrade, or account deletion.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALENT IS NOT LIABLE FOR ANY LOSS, CORRUPTION, OR INACCESSIBILITY OF YOUR CONTENT — whether caused by hardware failure, third-party service failure, software defect, user error, malicious action, force majeure, or any other cause. You upload Your Content to the Service at your own risk.
8. Disclaimers
THE SERVICE AND ALL CONTENT, FEATURES, AND FUNCTIONALITY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. ALENT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALENT'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ALENT FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). IF YOU USE ONLY THE FREE TIER, ALENT'S TOTAL LIABILITY IS CAPPED AT ZERO U.S. DOLLARS.
ALENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION.
10. Indemnification
You agree to defend, indemnify, and hold harmless ALENT from and against any claims, damages, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, your violation of these Terms, or your violation of any third-party right.
11. Termination
You may terminate your account at any time. We may suspend or terminate your account at any time, with or without notice, if we believe in good faith that you have violated these Terms, engaged in fraudulent or abusive activity, or that termination is necessary to comply with law or protect the rights of ALENT, our users, or the public.
12. Governing law and dispute resolution
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws principles. Disputes shall be resolved exclusively in the state or federal courts located in Maryland.
Class-action waiver: claims must be brought on an individual basis only and not as part of any class, collective, consolidated, or representative proceeding.
13. Miscellaneous
We may modify these Terms at any time by posting a revised version inside the Service and updating the Effective date above. Your continued use of the Service after the Effective date constitutes acceptance.
If any provision is held invalid, it shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force. Headings are for convenience only. Force-majeure events excuse non-performance. These Terms constitute the entire agreement between you and ALENT regarding the Service.
